These Terms of Service ("Terms") govern your use of the "Truth or Dare — The Ultimate Party Game" mobile application (the "App"), published by DrunkenDucks, a subsidiary of The Rising Techie ("we", "us"). By installing or using the App, you accept these Terms.

The App offers three age groups: Kids (0–12), Teens (13–17), and Adults (18+). You agree to select the age group that matches your audience and to obtain parental supervision when the App is used by a minor.

Truths and dares displayed in the App are generated by large language models. The content is provided for entertainment purposes only and does not constitute medical, legal, psychological, financial, or other professional advice. You are solely responsible for deciding whether to act on any prompt the App displays. If a prompt is unsafe, illegal, or inappropriate for the chosen age group, do not perform it.

6. Ads and in-app rewards

The App displays ads supplied by Google AdMob, including rewarded "Watch Ad to Unlock" interactions that grant in-app benefits in exchange for viewing an ad. Ads are delivered subject to Google's policies; we do not endorse and cannot guarantee the products or services advertised.

7. Intellectual property

The App, including its name, logo, design, code, prompts, category structures, sound effects, and curated content, is owned by us or our licensors and is protected by copyright, trademark, and other applicable laws. AI-generated content displayed in the App is provided to you under the same license as the App itself.

8. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the App will be uninterrupted, error-free, or free from harmful components.

9. Limitation of liability

To the maximum extent permitted by applicable law, and subject to the carve-outs in §9.1 below, in no event will we be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenues, data or goodwill, arising out of or in connection with your use of the App, even if advised of the possibility of such damages. Our aggregate liability arising out of these Terms or the App shall not exceed the greater of (a) the amount you paid us for the App in the twelve months preceding the claim, or (b) one hundred United States Dollars (USD 100).

10. Indemnity

You agree to indemnify and hold harmless DrunkenDucks, The Rising Techie, and their officers, employees, and agents from any claim, damage, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the App.

11. Termination

We may suspend or terminate your access to the App at any time if you breach these Terms or for any other reason at our discretion. You may terminate by uninstalling the App.

12. Changes to these Terms

We may update these Terms from time to time. The "Effective date" at the top will reflect the most recent revision. Continued use of the App after a change constitutes acceptance of the revised Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of India, without regard to its conflict-of-laws principles. The courts located in India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that we may seek injunctive or equitable relief in any court of competent jurisdiction. If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws grant you the right to bring proceedings in your country of residence, those rights are not affected by this clause.
